ChatGPT出來後我用了幾次，其翻譯功能很合我意，許多人拿它寫程式AI繪圖都好用，但我前陣子看到廖元豪關於大學「師生戀」的文章，想查資料用來檢討林萬億、李明璁乃至范雲、台大社工系主任鄭麗珍所謂私事的論述，一去問ChatGPT，竟然回答得很彆腳，今天看到新聞說Google Bard支援中文了，就試了一下，還可以喔：

我先問"自我抄襲"的定義，看來還不笨，我接著問關於美國共和黨總統初選的名單及民調結果，看它資料更新到甚麼時候，現在時間是2023/7/13，Google Bard更新的資料到了2023年4月21日，比ChatGPT只更新資料到2021年9月，好太多了。

其次，我問ChatGPT美國耶魯大學關於師生戀的英文原文相關規定，它說” 很抱歉，根據我所擁有的知識，耶魯大學並未公開針對師生戀的具體規定”。

相對的，Google Bard就回答了一堆，如果我要做相關的研究，目前來說，Google Bard找資料比較厲害。

廖元豪／大學「師生戀」該管嗎？怎麼管？

近日來台灣版#MeToo崛起，性騷擾指控不斷冒出，讓人心痛心疼之至。而大學教授與學生發展戀情甚至性關係，是否構成性騷擾或違反學術倫理，也成爭議事項。

大學生已是成年人，所以大學教師與學生的戀情乃至性關係，都是大法官釋字七九一號解釋所稱的「性自主權」，受到憲法第廿二條的保障。但大學教授與剛成年的學生，具有硬性的權力關係（指導、教學、評分等）以及軟性的輔導管教關係，甚至還常有著某種精神崇拜的可能。在這樣的結構下，師生間的戀情關係與性關係，是否該受到較嚴格的限制？

以台灣民情，大部分人應會同意師生戀應嚴加限制。但目前的法制卻存在盲點，使得管理很困難。最嚴重的就是規範不明。各大學對師生戀，幾乎都欠缺具體明確的禁止限制規範。在聘約上只約定與學生「不得發展有違專業倫理之關係」，各校的教師倫理規範多半也僅規定「不得性騷擾」。這些規定顯然不夠明確，例如，沒有指導關係的師生發生合意性關係，也「有違專業倫理」嗎？兩人在成為師生之「前」如果就是情侶也違規嗎？性騷擾必須構成「利益交換」或「敵意環境」才能成立，師生戀是否也有同樣的條件？社會學系教授不能與同系大一學生上床，但可與機械系博士生談戀愛嗎？

加上這些年來許多傳統的性倫理都在解構中，釋字七九一號解釋讓性自主可以在刑罰領域突破婚姻忠貞義務，甚至在解釋理由書還指出性自主權與人性尊嚴密切相關，其地位已超越婚姻的社會功能。文藝影劇小說作品以師生戀為題材（不一定是大學，如日劇「魔女的條件」，金庸名著「神鵰俠侶」等）者亦所在多有。如果沒有紮實的法理基礎加上明確的限制規定，這類事件還是有可能發生；而某些不肖教師更習於利用這種文化與地位的槓桿，避開「性騷擾」與「性侵」的法律界線，一再於校園獵食，造成校園安全問題。

要說性自主甚至性氾濫，美國應該遠邁台灣。但美國各大學也在廿一世紀起注意到師生戀與性騷擾的灰色地帶，紛紛訂定較為明確且嚴厲執行的倫理規範。鑑於規範的可行性及尊重個人自主權，各校規定還是有些差異。例如耶魯大學「師生自願關係政策」就規定，教師與大學部學生絕對不可以有「性關係或情慾關係」，但對老師與研究生的關係禁令，則限於有教學、指導或其他責任關係者。密西根大學規定得更細緻，將「性關係、戀情關係、情慾關係，與／或戀愛約會」關係都納入，對大學部學生與研究生也跟耶魯做出類似區分。但密西根大學規定在特殊情況下（主要是先當情侶才成為師生情況）可向校方申請「許可」。

我的母校印第安那大學則採取「揭露並適當處理」作法：只要有（或曾有）師生間的性關係或情慾關係，一律應申報，並由主管規定處理計畫（迴避是最起碼的要求）；未依規定揭露、申報，或不遵守處理計畫，即構成懲戒原因。每個學校的規範，都遠比我國大學詳盡，也反映出各大學的政策與哲學。

明明在師生戀議題上，台灣比美國更「民風淳樸」，但我們的大學卻鮮少作出明確規範。或許因為我們有尊重教授的傳統，覺得把「師生性關係」放在聘約或倫理規範中，有著冒犯的感覺。然而，模糊的規範難以操作，也會給部分師生踩線、試探的動機。說清楚講明白，反而是保護師生，維護校園倫理的最好方法。（作者為政治大學法律學系副教授）

Google 對話式AI 服務Bard 今天起支援中文，Google指出，今天起，使用者可以透過超過40種語言與Bard協作，包含繁體中文、德文、西班牙文、印度文以及阿拉伯文，可以在巴西與歐洲各地等更多地區使用Bard。

Bard基於Google大型語言模型基礎，透過學習網路資訊並提供高品質的回覆。今年5月，Google將Bard移植到 PaLM 2（更強大且更有效率的大型語言模型），利用PaLM 2模型實現許多調整與改進，將可做數學與推理和程式編寫能力。

Google指出，Bard透過兩項新功能，讓回覆更貼近用戶需求，第一是可以「聆聽」Bard的回覆（支援超過 40 種語言，包含繁體中文）。輸入想要了解或詢問的問題內容，並選取音效圖示，可以聽到Bard的朗讀回覆。例如用以理解單字的正確發音、聆聽詩詞或劇本時，這項功能就會特別實用。

第二是調整Bard的回覆（目前僅支援英文）你可以更方便地調整 Bard 的回應風格和語氣，目前共有五種選項供選擇，包含：易懂（simple）、長版（long）、短版（short）、專業（professional）和日常（casual）。舉例來說，可以讓Bard撰寫一則二手古董扶手椅的拍賣資訊，並透過選單來調整回覆內容。這項功能目前僅支援英文版本，更多語言版本將於日後推出。

另外，Bard 也能夠透過以下四項全新功能，協助用戶完成任務，第一是固定並重新命名對話（支援超過 40 種語言，包含繁體中文）：有許多使用者與我們分享希望能反覆查看自己所輸入查詢的提示與對話內容，因此，我們新增了固定及重新命名各個 Bard 對話的方式。當開始與 Bard 對話時，你會在側邊欄位中看到固定、重新命名以及選取最近對話等選項。舉例來說，你可以請 Bard 介紹並比較幾個適合夏天的室外運動，之後再來查看 Bard 整理提供的內容。

第二是匯出程式碼到更多地方（支援超過 40 種語言，包含繁體中文）：我們觀察到，有許多開發人員對於使用Bard進行程式編寫相關任務擁有高度興趣。因此，我們新增開放 Python 程式碼匯出功能的選項，除了Google Colab 外，也能夠匯出至 Replit。

第三是分享Bard的回覆（支援超過 40 種語言，包含繁體中文）：透過分享連結，現在你可以更輕鬆和你的親朋好友分享部分或完整的 Bard 對話，交換彼此的想法與創作意見。

第四是在提示欄中使用圖片（目前僅支援英文）：圖像對於激發想像力非常重要。在今年的 I/O 大會上，我們宣布將把Google智慧鏡頭的功能整合到 Bard。無論是想了解關於圖片的更多資訊，或需要靈感來撰寫一段與圖片相關的文字，都可以在提示文字中上傳圖片，Bard 將分析照片並提供協助。這項功能目前僅支援英文版本，更多語言版本將於日後推出。
