公民不服從 Civil disobedience
公民不服從(也稱政治不服從;英語:Civil disobedience),為在憲政體制下處於少數地位的公民表達異議的一種方式,是一種反對權的政治權利。
公民的「反對權」就是指「公民不服從」,雖可能涉及違法的行為,卻是出於「社會良知及正義」的公共利益之關注而不得已所選擇的一種手段,是少數人基於對法律忠誠的一種喚起多數人認同的非常手段。
基於公民的道德、良知所從事的「公民不服從」,這是不同於一般的「暴民反抗」及「暴動」。 「公民不服從」參與者的訴求,是否符合「社會良知及正義」的公共利益是須要訴諸社會多數人的認同所進行的一種抗爭行為。
